Terms of Use

These Terms of Use (the “Terms”) govern the relationship between BoxBak (“we”, “us”) and anyone who signs up for or uses the BoxBak service (“you”). By signing up, signing in, or using any part of the service you agree to be bound by these Terms. If you do not accept them, please stop using the service. This English version is provided for convenience — the Thai version prevails if the two conflict.
1. Our service
BoxBak is a browser-based restaurant management system covering point of sale (POS), kitchen display (KDS), ingredient inventory, recipes and costing, reports, team and shift management, QR table ordering, and other features we make available from time to time. Some features are limited to certain plans or offered as temporary previews. We may add, change, or retire features, and will use reasonable efforts to give advance notice when core functionality is affected.
2. Accounts and security
- The person who opens a store account (the “owner”) must provide accurate, up-to-date information and have authority to act for the business.
- The owner creates staff accounts and assigns their permissions, and is responsible for activity carried out through those accounts.
- You must keep passwords, PINs, and bound devices confidential. If you suspect unauthorized access, change your credentials and notify us promptly.
- Accounts may not be transferred, sold, or shared with third parties beyond normal use within your store.
3. Your responsibilities and prohibited use
- Use the service only for lawful business operations.
- Do not use the service to break the law, infringe others’ rights, or knowingly record false data (for example, fabricated sales or stock records).
- Do not attempt to breach, probe, modify, or reverse engineer the system, or access another store’s data by any means.
- Pricing, tax, receipts/tax invoices, payroll, and compliance with labour, accounting, and tax law remain the store’s responsibility. BoxBak is a tool that records and calculates on your behalf.
4. Plans, fees, and free trial
- New sign-ups may receive a free trial under the conditions published at the time, with no card required. When the trial ends you can choose a paid plan or continue on the free plan within its feature limits.
- Fees, billing cycles, and payment methods are as shown in the system or as otherwise agreed. If payment is overdue we may downgrade the plan or restrict features; your store’s data is retained.
- We will give reasonable advance notice of price changes that affect your current plan.
5. Cancellation and refunds
- Fees are prepaid per billing cycle (monthly or annual). You may cancel or downgrade at any time, effective at the end of the paid cycle — you keep the features of your current plan until that cycle ends, and your data is not deleted.
- Once a billing cycle has started, fees for that cycle are non-refundable, in full or pro-rata. Downgrades are re-priced from the next cycle with no refund of the difference.
- Exceptions — we refund in full when you are charged twice or charged an incorrect amount due to an error on our side or the payment provider’s, or when you have paid but the plan was not activated and we cannot fix it within a reasonable time.
- If the service suffers a significant, sustained interruption caused by our fault, we may compensate with extended service time or service credit as reasonable.
- The free trial is free of charge, so there is nothing to refund for the trial.
- Submit refund requests via the contact channel at the end of these Terms. Approved refunds are returned through the original payment method within a reasonable time. Nothing in this section limits rights you have under consumer protection law.
6. Your store’s data
- Data your store records in the system (menus, recipes, sales, stock, staff records, etc.) belongs to your store. We receive only the rights needed to operate, maintain, and improve the service.
- Each store’s data is isolated at the database level, and key financial and stock records are kept in an auditable, tamper-evident form.
- Personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.
7. Service availability
- We aim for continuous availability but do not guarantee uninterrupted service. Maintenance windows may occur and we will try to announce them in advance.
- The POS keeps working while your internet connection is down and syncs back when it returns; offline operation is nevertheless subject to the limits of your device and browser.
- We back up data on a standard schedule, and recommend exporting important reports periodically.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or special damages, or for lost profits or business opportunities, arising from use of or inability to use the service; and our total liability for any claim is capped at the fees your store paid us in the 12 months before the event. This does not limit rights that cannot be excluded by law.
9. Suspension and termination
- We may temporarily suspend or restrict use if we find a breach of these Terms, a risk to system security, or a legal requirement, and will state the reason where circumstances allow.
- The owner may cancel the service at any time. After cancellation we retain data for the period stated in the Privacy Policy — to allow recovery and to comply with applicable law — before deleting or anonymizing it.
10. Intellectual property
The software, marks, logos, and content we produce are our property. We grant you a limited, revocable, non-transferable licence solely to use the service under these Terms. Copying, modifying, or re-offering the service without our written permission is prohibited.
11. Changes to these Terms
We may amend these Terms from time to time. For material changes we will give reasonable advance notice through the system or by email. Continued use after an amended version takes effect constitutes acceptance of it.
12. Governing law
These Terms are governed by the laws of Thailand, and disputes are subject to the jurisdiction of the Thai courts.
